The Navajo Division of Transportation (Navajo DOT) is not liable for vehicle damages, injuries, or other issues caused by roadway conditions such as potholes. Travelers assume all risks and Navajo DOT does not cover repair costs.

Public vs. Non-Public Roads: 

• Public roads are maintained by public authorities, open to general traffic, and include roads on tribal lands under jurisdiction of Navajo Nation, state, or federal agencies (per 23 CFR § 460.2 and CFR § 1340.3).
• Non-Public roads are owned and maintained by individuals or organizations, with restricted access. Use of non-public roads without permission may be trespassing. (per 23 CFR § 1340.3)

By reporting a pothole, you acknowledge and accept these conditions. Navajo DOT’s responsibilities are limited to public roads under its jurisdiction.
